The term “our online services” refers to our website (, our pages on third party social media platforms such as Instagram, Facebook, Twitter, Pinterest and Google+ and any other websites or apps we may own or run from time to time. If you use any of our services, we will refer to you using the terms “user”, “visitor”, “you”, “your”, “yours” in this policy. By using and submitting information to our website (the “Site”), you are agreeing that we may collect, use and disclose the information we collect in accordance with the purposes and uses identified in this policy. If you are under 16, you must inform a parent or guardian about our privacy policy to obtain their agreement to the privacy policy before registering, subscribing or placing an order with us.

John Hardy respects the privacy rights of our customers and visitors; and as part of that commitment we utilize Secure Sockets Layer (SSL) technology. This privacy policy outlines how we collect, store and use the personal information that you provide to us.

If this policy changes, we will revise this portion of our Notice of Privacy Practices and will comply with the requirements of the Children's Online Privacy Protection Act, which includes providing notice and choice to each child's parent or guardian before collecting any personal information.

Our privacy practices may vary amongst the countries in which we operate to reflect local practices and legal requirements in the given jurisdiction.


1.1 Personally Identifiable Information we collect

For purposes of this privacy policy, “personal information” (PII) means any information by which someone can be personally identified, including name, address, telephone number, email address, billing and account information, credit or debit card information, and other similar information. Information you provide: We collect various information when you create a profile, place an order, create a registry or take advantage of other programs online or in store. Information we may collect includes: Name, Address (billing and shipping), Email address, Telephone number(s), Credit card number(s), Birth date, and Security question answers. Transaction Information: Transaction Information includes items purchased and date and time of your transaction, for in-store or online purchases. When you make a purchase or create a gift registry, we may share information about you and your transaction with other companies necessary to process your transaction or offer you products or services that may be of interest.

Clienteling/Client Book: While in our stores, a John Hardy sales associate(s) may ask for your permission to enter your information into their client book. This is so that the associate can communicate with you on a one-to-one basis about John Hardy products that may be of interest to you or fulfill orders at your requests. Information sales associates collect includes: Name, Telephone number(s), Email, Credit card number (so transactions may be made on the client's behalf and at your request) and Address (billing and shipping). Information stored in our client book may be accessed and used by other John Hardy personnel.

Sweepstakes, Contests and Promotions: If you win a sweepstakes or contest, your PII may be disclosed on a winner’s list as required by law. In addition, by entering a sweepstakes or contest, you consent to the use of your PII by us and service providers providing services in connection with such sweepstakes or contest for purposes of prize fulfillment and/or for marketing, such as to notify you of a product or promotion that may be of interest to you. If you no longer wish to receive emails about products or promotions that may be of interest to you, you can always opt out of receiving further information by clicking on the “unsubscribe” link included in such emails.

1.2 Non-Personally Identifiable Information we collect

Technology-Enabled Collection Services: We collect data when you visit our websites, shop in our stores, or interact with our other technologies. This information is either automatically collected or is customer initiated.


We, and third party business partners, collect non-personally identifiable information about your website use and browsing behavior in the form of cookies. Cookies are small files sent by us to your computer or device that help us gauge the success of our site and will track session information such as what pages you access and for how long, which allows us to make updates to enhance your experience including recognizing your preferences to make shopping easier for you and providing you with a customized experience. You can set your browser to reject cookies or to notify you when you are sent a cookie. You may also obtain third party software that will allow you to visit the site without providing the information gathered by cookies. Most internet browsers enable you to erase cookies from your computer hard drive, block all cookies, or receive a warning before a cookie is stored. Our customers are at the heart of what we do. We collect your personal data in order for us to communicate with you where required, to provide you with our products and services, to understand better your consumer journey to purchase, and to analyze trends amongst our customer generally. We only use personal information in accordance with applicable privacy laws.

3.1 Personally Identifiable Information

When you use our services: If you use any of our services, register for or attend one of our events, set up, look at or change your account details or contact a member of our Client Care team, we will record your personal details. Your information will be used in the first place to provide the products, services or information you have asked for and to provide you with a personalized shopping experience. We keep the information you provide and may use it for several purposes, including: (i) accounting, billing, reporting and audit; (ii) credit checking or screening; (iii) authentication and identity checks; (iv) credit, debit or other payment card verification and screening; (v) debt collection; (vi) safety, security, health, training, administrative and legal purposes; (vii) data matching and dedupe, statistical and market analysis, and marketing information; (viii) advertising and marketing; (ix) developing, testing and maintaining systems; (x) studies, research and development; (xi) customer surveys; (xii) customer care and to help us in any future dealings with you, for example by identifying your requirements and preferences; (xiii) where required by law or in connection with legal proceeding or disputes; and (iv) any other uses set out in the terms and conditions for use of our services.  Saved payment card details will only be shared with our payment partner and not with any other third parties and will only be used to process your order, using our payment partner's systems. We may also use your personal information to send you marketing updates, as detailed in the next section.


3.2 Non-Personally Identifiable Information

Tracking how our online services are used: We collect and use third parties to collect and share with us, information from visitors to our online services and analyze it to understand how people use our website which is used to help make improvements. We may also give anonymous statistics about visitors to other reputable organizations, but the information we provide will not include details that would allow these organizations to identify you.

Customization of our online services and advert targeting: We may use the information you give us about yourself and the information we collect via cookies when you use our online services to build up a picture of your interests. We may then use this information to try to make sure that when we send you marketing communications and when you visit our websites or use our online services, you don't miss information that might interest you. This information may also be used by our third party advertising agencies and networks to advertise our own or third party products and services to you when you visit third party websites and online services. Social networks: If you follow us or interact with us on any of our pages on third party social media platforms, such as Instagram, Facebook, Twitter, Pinterest and Google+, information you provide will be subject to the third party’s privacy policy, as well as this privacy policy.

Direct marketing: For information on how we may market to you, please read the section called “Marketing Opt-in and Opt-out”.

Customer surveys: On occasion we may ask you for your opinion on our services and the products you have purchased through our services. When we do research or surveys, we may use cookies and may combine the information collected by those cookies with your answers.


We do not sell or otherwise disclose personal information we collect about you, except as described in this Privacy Policy. We may share your information with third party business partners, engaged by John Hardy under binding non-disclosure agreements to provide information to us about you, or to collect information on our behalf. We may also share your data, such as non-identifiable cookie information, with third party business partners to engage in interest based or behavioral advertising.  

We aggregate data to create a holistic view on site traffic, sales, wish lists and other information, which may be shared with third party business partners; however, this information does not include any details that can identify you personally.

The types of third party business partners may include: (i) data processing companies, mailing houses and other third party suppliers working on our behalf; (ii) ad-serving agencies and other advertising intermediaries; (iii) credit reference or fraud prevention agencies, which may keep a record of that information; (iv) regulatory bodies, government and enforcement agencies, such as the police.
Every now and again, we receive requests for information from government departments, the police and other enforcement agencies. If this happens, and there is a proper legal basis for providing your personal information, we will provide it to the organization asking for it.

We may on occasion provide a link to a third party website. If you elect to provide your personal information on that third party website, this information will be subject to that third party website's privacy policy and security practices. We are not responsible or liable for any content presented by or contained on any independent website, including, but not limited to any advertising claims or marketing practices. We are also not responsible or liable for any privacy or security policies of these third party sites.

In the unlikely event that the Company or substantially all of its assets are acquired by another company, or due to any merger or reorganization, customer information will be one of the transferred assets. Your personal information will be subject to any pre-existing privacy policy unless you agree otherwise.


John Hardy partners with third party companies to serve digital advertisements. These third parties collect anonymous, non-personally identifiable information to provide insight to advertisement performance and relevance. These third party companies may set and access their own cookies, pixel tags and similar technologies on your device and they may otherwise collect or have access to information about you, including information regarding your usage of our website. Marketing Opt-in and Opt-out: we offer you the chance to receive communication surrounding our brand, product and services. We, or a third party business partner, may ask if would like to receive these types of communication.

In-Store Customer Registry: You may join our Customer Registry at our Stores. To join, we ask for your name, postal address, email address and mobile and home telephone numbers. You also may choose to provide us with your birth date and gender. We use this information to be able to uniquely identify your registry and to communicate with you about our products, services and promotions and for other marketing and customer service purposes.


The secure handling of your privacy is a priority for John Hardy, and we are committed to handling your personal information carefully.  We maintain reasonable physical, electronic and procedural safeguards to guard your personal information. We use secure socket layer (“SSL”) technology to protect the security of your credit card information and we encrypt this information when it is sent over the Internet. We also use firewall technology, password controls and other technological and procedural safeguards in maintaining the Site. We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.


10.1 California Civil Code Compliance: Section 1798.83 of the California Civil Code permits California residents to request from a business, with whom the California resident has an established business relationship, certain information about the types of personal information the business has shared with third parties for those third parties’ direct marketing purposes and the names and addresses of the third parties with whom the business has shared such information during the immediately preceding calendar year. 10.2 Special Notice for Canadian Users: We may store or process your personal information on servers in jurisdictions outside of Canada, including in the United States of America. While your personal information is in a jurisdiction it may be accessed by the courts, law enforcement and national security authorities of that jurisdiction, or otherwise, in accordance with the laws applicable in that jurisdiction.

10.3 Children’s Privacy: The Children's Online Privacy Protection Act imposes requirements on Web sites that collect personal information about children under 13 years old (for example - name, address, email address, social security number, etc.).  Our Site is not directed to children under the age of thirteen, and we will never request or knowingly collect personally identifiable information online from any person under the age of thirteen without verifiable parental consent. If we become aware that a customer is under the age of thirteen and has registered without prior verifiable parental consent, we will remove his or her personally identifiable registration information from our file. If this policy changes, we will revise this portion of our Notice of Privacy Practices and will comply with the requirements of the Children's Online Privacy Protection Act, which includes providing notice and choice to each child's parent or guardian before collecting any personal information.

10.4 International Customer Privacy: To fill international orders, John Hardy partners with Borderfree, Inc. (formerly FiftyOne). Borderfree will carefully store, handle, and process your personal information as more fully set forth at Borderfree participates in and has certified its compliance with the EU-U.S. and the Swiss-U.S. Privacy Shield Frameworks, and is committed to subjecting all personal data received from European Union (EU) member countries and Switzerland, respectively, in reliance on each Privacy Shield Framework, to the Framework’s applicable Principles.
